Terms of Service

These terms apply to the Caught! app for iOS (the "Application"), created by Tortuga Labs, LLC (the "Service Provider", "we", "us"). By downloading or using the Application you agree to these terms. If you do not agree, do not use the Application.
The Application
Caught! is a tracker for trading card collections. It lets you define collections, mark the cards you own, record their condition and quantity, add your own photos and custom cards, and share a list of the cards you still want.
License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the Application on Apple devices you own or control, as permitted by the App Store's usage rules. You may not:
- copy or modify the Application or any part of it;
- attempt to extract its source code, or reverse engineer it, except where the law allows this despite this restriction;
- translate the Application into other languages or make derivative versions;
- rent, sell, or sublicense the Application;
- use the Application in any way that is unlawful or that interferes with its operation.
The Application, and all trademarks, copyright, database rights, and other intellectual property rights related to it, remain the property of Tortuga Labs, LLC or its licensors.
Trademarks and card data
Caught! is an independent, unofficial app. It is not affiliated with, endorsed by, or sponsored by Nintendo, The Pokémon Company, Game Freak, or Creatures Inc. Pokémon, Pokémon character names, and the Pokémon Trading Card Game are trademarks of their respective owners. Card names, images, and related content remain the property of their respective owners and are shown for identification and reference only.
Card data and card images are drawn from third-party sources, including TCGdex. We work to keep the catalog accurate, but it may contain errors or omissions, be incomplete, or lag behind new releases. Card images are loaded from a third-party host and may be unavailable at times.
Your content
Your collections, photos, and custom cards are yours and are stored on your device. You are responsible for the content you add and for having the right to use it.
When you send a report of an inaccurate scan, you give us permission to use the report, including any card photo sent with it, to review and correct the card catalog.
Your data and backups
The Application stores your collections on your device. There is no cloud backup or sync operated by us at this time. If you delete the Application, or lose, reset, or replace your device without a device backup, your collections may be lost and we cannot recover them. You are responsible for backing up your device.
Accounts
Signing in with Apple is optional and the Application works fully without it. Signing in reserves an identity for a future backup and sync feature; it does not create an account on our servers today.
Privacy
Our handling of information is described in the Privacy Policy at /privacy, which forms part of these terms.
Not a valuation or trading service
The Application is for personal record keeping. It does not appraise, grade, authenticate, buy, or sell cards. Condition and quantity are whatever you record. Do not rely on the Application for decisions about buying, selling, insuring, or valuing cards.
Purchases
The Application currently offers no paid features. If paid features are added, purchases will be processed by Apple through your App Store account, will be final and non-refundable except where required by law, and will be managed through your App Store account settings.
Internet and device
Some features need an internet connection, such as loading card images. We are not responsible for the Application not working at full functionality if you have no connection or no data allowance left. Your mobile carrier may charge you for data, and those charges are your responsibility.
You are responsible for keeping your device secure. We recommend that you do not jailbreak your device, as this may expose it to malicious software and may mean the Application does not work correctly.
Updates and availability
We may update the Application from time to time, and the operating system requirements may change. You may need to install updates to keep using the Application. We do not promise that it will always be updated to work with the iOS version on your device. We may change or stop providing the Application at any time, and may end your use of it without notice. On termination, the rights and license granted to you in these terms end and you must stop using the Application.
Disclaimer of warranties
The Application is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent permitted by law.
Limitation of liability
To the fullest extent permitted by law, Tortuga Labs, LLC is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of or inability to use the Application, including any loss resulting from reliance on the card catalog. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
Apple
These terms are between you and Tortuga Labs, LLC, not Apple. Apple is not responsible for the Application or its content and has no obligation to provide maintenance or support for it. If the Application fails to conform to any applicable warranty, you may notify Apple for a refund of the purchase price, if any; to the fullest extent permitted by law, Apple has no other warranty obligation for the Application. Apple is not responsible for addressing any claims relating to the Application, including product liability claims, consumer protection claims, or claims that it infringes a third party's intellectual property rights. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.
Children
The Application is not directed to anyone under the age of 13. If you are under the age of majority where you live, use the Application only with the permission of a parent or guardian.
Changes to these terms
We may update these terms from time to time. The updated terms will be posted at /terms with a new date. Continued use of the Application after a change means you accept the updated terms.
